New Delhi: The Supreme Court on Wednesday (January 24) again adjourned the hearing on student leader Umar Khalid’s bail plea. Khalid was arrested in September 2020, in connection with Unlawful Activities (Prevention) Act a case relating to the North-East Delhi communal violence in February that year.A bench of Justices Bela Trivedi and Ujjal Bhuyan was hearing Khalid’s special leave petition challenging the Delhi high court’s decision to deny him bail, Livelaw reported. Khalid has also filed a writ petition challenging various provisions under the UAPA.The hearing was reportedly adjourned on Wednesday because Justice Trivedi had to be in a different special bench combination to hear another matter. The matter has now been listed for January 31, with Justice Trivedi saying it would be “high on the board” on that day.Khalid’s bail plea hearing has now seen multiple delays and adjournments. His prayer for bail was rejected by a trial court in Delhi in March 2022. He then moved the Delhi high court in October 2022, which upheld the trial court order. The student leader then approached the Supreme Court in May 2023.After the matter came up before the apex court for the first time on May 18, 2023 it was adjourned twice, once on July 12, 2023 after the Delhi Police sought more time to file a counter-affidavit, and then again on July 24.Justice Prashant Kumar Mishra had then on August 9 last year recused himself from hearing the plea. Even at the last hearing, when the plea was posted for Wednesday, the bench had said, “An impression goes out that the Court is not taking up the matter” and so no further adjournments would be given.
