New Delhi: The Supreme Court on Friday (October 30) dismissed a plea filed by the National Investigation Agency (NIA) challenging the bail granted to Jammu and Kashmir human rights activist Khurram Parvez in a case under the anti-terror law, reported PTI.The Delhi high court, in July, had granted bail to Parvez, who is the programme coordinator of the Jammu and Kashmir Coalition of Civil Society (JKCCS) and chairperson of the Asian Federation against Involuntary Disappearances, in a case under the Unlawful Activities Prevention Act (UAPA) over alleged terror funding. The high court had observed that his prolonged incarceration of nearly four-and-a-half years, slow progress of trial, and his right to personal liberty under article 21 of the Constitution of India, warranted his release on bail, LiveLaw reported. Parvez was arrested on November 22, 2021, from Srinagar. The NIA had alleged that he was linked to the banned terrorist organisation Lashkar-e-Taiba (LeT) and recruited Over Ground Workers (OGWs). They additionally alleged him of gathering intelligence on security installations and facilitating terror funding. On Friday, a Supreme Court bench comprising Justices M.M. Sundresh and P.B. Varale refused to interfere with the high court’s order, also taking into considering Parvez’s long incarceration. The bench thus disposed of the NIA’s plea challenging Parvez’s bail. Senior Advocate Tanveer Ahmed Mir, appearing for Parvez, submitted that he has a prosthetic leg and has been in custody for nearly five years now. He argued that the framing of the charges has been deferred since the NIA, on August 19, sought time to file a supplementary chargesheet.
