New Delhi: The Supreme Court has said the long period of adjournment set by the Delhi high court to hear a petition requesting FIRs against politicians who made hate speeches that may have incited riots is ‘unjustified’, asking the matter to be listed on Friday.Hearing two petitions on Wednesday – one filed by a group of 9 riot victims and another by social activist Harsh Mander – a bench headed by Chief Justice of India S.A. Bobde asked the Delhi high court to hear the matter ‘expeditiously’. According to LiveLaw, the chief justice remarked, “We don’t think the extent of such period of adjourning the matter is justified. We are of the view that the matter be heard on Friday. Our intention is to get political leaders who are polarised to talk to people and bring about peace. You can do that in the Delhi High court as well.”Mander had on February 26 filed a petition in the Delhi high court seeking the registration of FIRs against BJP leaders Kapil Mishra, Anurag Thakur and Parvesh Verma, saying their speeches had incited riots in Northeast Delhi. More than 45 people have died in the riots and more than 200 have received serious injuries.While a bench of Justices S. Muralidhar and Talwant Singh asked the Delhi police to take a ‘conscious decision’ on the registration of FIRs, the matter reverted to the Delhi HC chief justice’s court on February 27, which accepted the Centre’s logic that the situation is ‘not conducive’ to register FIRs. The matter was adjourned to April 13.On Wednesday, the Supreme Court said the Delhi HC should explore the possibility of peaceful resolution. The bench, also comprising Justices Surya Kant and B.R. Gavai, heard arguments from Colin Gonsalves, appearing for the petitioners, and solicitor general Tushar Mehta.Mehta, continuing with the line of argument he made in the Delhi HC, claimed that ‘both sides’ had made incendiary statements. He read out excerpts from a video of Harsh Mander, in which he had asked Muslims to protest against the Citizenship (Amendment) Act as proof of this. However, CJI Bobde said that arresting politicians may not result in riots being curbed.
