New Delhi: The Supreme Court has hauled up the Greater Noida executive magistrate over a notice it issued to a student over their alleged campaign in favour of the student protests led by the Cockroach Janata Party and Left groups in July.LiveLaw reported that the bench led by the Chief Justice of India asked how the executive magistrate could issue the notice when the Supreme Court has quashed the first information reports over the student protests and barred any future coercive action against any student over their participation in them.Invoking its special powers under Article 142 of the Constitution, the Supreme Court on September 1 had ordered that FIRs lodged across the country against youth protesters in connection with their agitation carried out between July 20 and 25 stand quashed.The notice had been issued under Section 130 of the Bharatiya Nagarik Suraksha Sanhita. This section is meant to be used by executive magistrates when there is credible information that a person’s actions might disturb public order.Senior Advocate Bishwajit Bhattacharyya brought the matter to the attention of the CJI-led bench and submitted that the executive magistrate issued notice to a second-year student of the Gautam Buddha University, asking him to show cause for not furnishing a personal bond of Rs 5 lakh to ensure that he will preserve peace.The notice was withdrawn eventually, Bhattacharyya said.“This is an experiment with students of India. This is prima facie contempt. Authorities of Noida and UP can’t create fear psychosis among students,” the lawyer said, according to the LiveLaw report.The CJI also took a dim view of things. “How could a magistrate dare to issue notice? We made clear no coercive action against any student! No magistrate could violate that order,” he said.Justice Joymalya Bagchi, according to the report, asked what cause of action survived if the notice has been withdrawn. Bhattacharyya observed that the issue related to the contempt of the court. “It is contempt of the majesty of this court. This is the highest court of the country, which is holding the court of our democracy,” he submitted.The court eventually issued notice to the Executive Magistrate III, Greater Noida.
