New Delhi: The Delhi high court on Tuesday (July 21) allowed the shifting of climate activist and innovator Sonam Wangchuk from the Safdarjung hospital to Medanta hospital, while noting the fact that there was a consensus among government and private doctors that there is a need for constant monitoring of his health, reported LiveLaw.“After going through reports and after interacting with AIIMS doctors and doctor who attended him, there is consensus that constant monitoring is required. As per Dr. Tandon, he has to be monitored in hospital. The concern expressed by Wangchuk in his letter is also to be taken into consideration. We propose that he be shifted to Medanta, hospital of his choice,” said a high court bench of Chief Justice D.K. Upadhyaya and Justice Tejas Karia.The court made the remarks while the hearing of the plea filed by Wangchuk’s spouse Gitanjali Angmo challenging a single judge’s refusal to allow him to shift him to a private hospital.Solicitor General (SG) Tushar Mehta, who appeared for the Union government, said that the government doesn’t have any objection to Wangchuk being shifted to Medanta, but he may not get discharged against medical advice.Senior advocate Akhil Sibal, who appeared for Wangchuk also drew the high court’s attention to a letter written by Wangchuk about experience at Safdarjung Hospital, including complaints regarding police presence, restrictions on phone access and surveillance.“We propose to get him shifted to Medanta. He will be treated there. All treatment details and reports prepared at Safdarjung will be supplied to Medanta. We will pass orders after lunch,” said the high court.Earlier, even as the Delhi police on Monday (July 20) cracked down on student protesters demanding accountability from the Bharatiya Janata Party (BJP)-led Union government over flaws in the education system, the Delhi high court on Monday had refused to urgently hear a public interest litigation (PIL) about the forceful removal of climate activist and innovator Sonam Wangchuk from the Jantar Mantar.“What is the urgency? That can be declared illegal even on Wednesday. You are seeking a declaration that can be made day after tomorrow also,” Chief Justice Upadhyaya had said on Monday, reported New Indian Express.The PIL sought that the removal of Wangchuk be declared as “illegal” and also asked for “constitutional protection of the protestors”. The plea alleged that the forceful removal of Wangchuk by the police from Jantar Mantar where he was on a hunger strike was illegal and against Article 14 (fundamental right of equality before law) and 19 (freedom of speech and expression) under the Constitution”.“We are seeking constitutional protection of the protesters. A lot of lives are in danger,” said the petitioner.The high court on Monday had sought a “comprehensive” medical report from Safdarjung Hospital on Wangchuk’s health condition by Tuesday. Gitanjali Angmo, Wangchuk’s spouse alleged that he was “forcibly” kept there by the Delhi Police to prevent him from taking part in the protests.Wangchuk has continued his hunger strike even after he was forcefully shifted to the Safdarjung hospital by the Delhi police, His hunger strike entered 24th day on Tuesday.Earlier, the Resident Doctors’ Association at the Vardhman Mahavir Medical College and Safdarjung Hospital, where Sonam Wangchuk is being held, had written to the president of India seeking immediate intervention to uphold Wangchuk’s constitutional rights and patient autonomy.“The Resident Doctors’ Association, VMMC & Safdarjung Hospital, respectfully expresses its deep concern regarding recent developments surrounding the continued hospitalisation of Mr Sonam Wangchuk at Safdarjung Hospital, which have raised important questions relating to patient autonomy, medical ethics, institutional independence, and the functioning of public healthcare institutions,” the doctors had written.
