New Delhi: A Supreme Court bench led by Chief Justice of India Surya Kant said today, October 16, that it will hear on October 26 or 27 an application by a journalist who is three-months pregnant and has alleged that Congress leader Rahul Gandhi shoved her on October 12.On that day, the Leader of the Opposition of the Lok Sabha and other opposition leaders marched to the Supreme Court to file a petition against the Election Commission of India. The petition was necessitated by the fact that the CJI himself had refused to meet Gandhi and Congress leader Mallikarjun Kharge and preferred a formal petition. The CJI, incidentally, said today that no additional matters will be listed after the mentions and cited the “heavy workload of benches,” Bar and Bench reported.“Let me be very clear. Benches are very overburdened. Briefs have been going to all the benches since the morning itself. Let me be very clear, today no matters will be additionally listed after mentionings,” he said.A journalist had claimed that Gandhi pushed her at the crowded Supreme Court premises. The case was mentioned by Senior Advocate Gaurav Bhatia. The bench also had Justice Joymalya Bagchi.LiveLaw reports that the bench said that it cannot take note of an oral submission, and said that an application has to be filed.“Lady journalist pushed by LoP Rahul Gandhi, she was 2 months pregnant. I have a report. What am I urging? Cognizance of this news be also taken. Lady journalist because she is reporting against him…selective outrage, nothing else. Why should cognizance not be taken of Rahul Gandhi pushing her?” Bhatia submitted a day ago, according to LiveLaw.“Not taking suo motu of an oral submission. File petition, will like to examine,” the CJI said.On October 12,, while interacting with reporters on the sidelines of the NHRC foundation day celebrations, when media personnel asked CJI Kant about the ongoing protests against the CEC in Delhi, he said, “Ye mera mudda nahin hai (This matter doesn’t pertain to my domain).” He added that the matter was related to law and order instead.
