New Delhi: Two days after Chief Justice of India Justice Surya Kant said that he did not have the time to watch videos of police brutality of protesters, he has said that reports saying that he refused to list a petition challenging the police action against student protesters were “completely false.”The CJI, according to reports including on LiveLaw, claimed that no writ petition on the issue had been filed before the Supreme Court.CJI Surya Kant occupies a unique position in the protests which saw and are seeing police brutality. In May, his remarks saying, “There are youngsters like cockroaches, who don’t get any employment and don’t have any place in profession” led to the formation of the Cockroach Janata Party which has been pushing for the resignation of education minister Dharmendra Pradhan for the last couple of months. A march to the parliament saw close to 75,000 gather near the Jantar Mantar. During it, police lathicharged indiscriminately, tear gassed protesters and despite denial, fired pellet guns and used nail-studded batons.On July 22, the CJI told lawyer Narendra Mishra who mentioned the petition challenging police action on protesters, “Don’t waste our time, and don’t waste your time.”When the lawyer said that there were videos showing police using excessive force, the CJI said the following words: “We are not interested in videos; we don’t have time to watch.”Today, July 24, the CJI said that a mere representation could not have been treated as a writ petition in the absence of any formal filing.He called the media reports on his words “irresponsible and reckless.”“In the last two days, a completely false statement was made that a matter was filed, and the media is absolutely free from all responsibility, falsely reporting that the Chief Justice refused to list the matter. Till morning 10 AM, not a single page has been filed. It was one representation…sent by that Mishra or someone. How can I treat the representation as a writ petition? And people start recklessly reporting this,” the CJI said, according to LiveLaw.The report said that the CJI made these remarks when Senior Advocate Shoeb Alam mentioned another matter for listing.Most reports had focused on the CJI’s remarks rather than his unwillingness to list the matter urgently.A day ago, CJI Surya Kant said in the morning that the top court will intervene if the Supreme Court metro station is not opened by afternoon. It is noteworthy that 17 Metro stations were shut down yesterday by the authorities, severely inconveniencing not just people who wanted to attend the protests but also workers and service givers.Constitutional lawyer and a former president of the Supreme Court Bar Association, Dushyant Dave, said in an exclusive interview to Karan Thapar that the comment was irresponsible and insensitive.
