New Delhi: The Supreme Court has asked the Election Commission to publish on its website the list of names excluded from the draft electoral rolls it published after the Bihar special intensive revision (SIR), along with the reasons for deletion and also to include Aadhaar to the list of documents accepted for the exercise, LiveLaw has reported.The Supreme Court bench of Justices Surya Kant and Joymalya Bagchi passed the order on Thursday (August 14) after a long hearing of all the parties.In its order, the court directed the ECI to display the list of around 65 lakh voters whose names appear in voter list of 2025 but are not included in draft list, on the website of every district electoral officers (district-wise). While the info will be booth-wise but it should be accessed by referring to the EPIC number of voter.The bench added that in order to make voters aware, the list should disclose the reason for non-inclusion of these persons in the draft roll. The ECI has also been asked to widely publicise the displaying of the list, through newspapers having maximum circulation in Bihar.In addition, the list also has to be broadcast on Doordarshan and radio channels. The court has also said that if district electoral officers have social media site, they will have to display the public notice on that site as well.The top court stated that it has to be also expressly mentioned in the public notice that the aggrieved persons may submit their claims along with copy of Aadhaar card.In addition, booth-wise lists of the voters shall also be displayed on notice board by each booth-level officer in panchayat offices with reasons for the exclusions to enable public to have access to these lists, the court said in its order.“Why don’t you put all deceased/migrated/duplicated elector names on website? We are not being critical of your not doing something…transparency will help create voter confidence. Why don’t you take an additional step of putting it up on website, clearly identifying persons who are not there, with reasons, so that they can take remedial measures?” Justice Bagchi had said during the hearing.Advocate Prashant Bhushan, had, a day ago asked why the ECI removed the searchable version of the draft roll from its website on the very day after Lok Sabha leader of opposition Rahul Gandhi’s press conference alleging voter list manipulations.The ECI has listed 11 documents for inclusion in the rolls. Among them is the birth certificate, but the list did not have the Aadhaar card, the voter ID card or the ration card, although The Wire has reported how in various places, poll officials collected these documents. While the Supreme Court had in the initial days of the hearing suggested that these need to be accepted, the ECI had stuck to its stand in affidavit replies.While hearing the challenge to the ECI’s SIR exercise in Bihar, the Supreme Court on August 13 had asked the petitioners whether the ECI does not have the residual power to conduct such an exercise in a manner it deemed fit.This is a developing story and will be updated.Read The Wire‘s full coverage of the Bihar SIR here.
