New Delhi: The Delhi high court will not hear today the bail pleas filed by scholar activists Sharjeel Imam and Umar Khalid, both of whom have been in jail for six years without trial in the case in which Delhi Police is alleging a ‘larger conspiracy’ in the 2020 Delhi riots. A division bench comprising Justice Prathiba M. Singh and Justice Dinesh Bhatt have adjourned the matter which was supposed to be heard today on the prosecution’s request, LiveLaw reports.Additional Solicitor General S.V. Raju, who represents Delhi Police or the prosecution in this case, is unwell.The court has also listed former Aam Aadmi Party councillor Tahir Hussain’s bail appeal on November 4.Imam and Khalid have both challenged the latest rejection of their bail pleas respectively. Imam’s appeal arises from the rejection of his second regular bail application; Khalid’s from the rejection of his third. They are charged under the Indian Penal Code with Sections 13, 16, 17, and 18 of the Unlawful Activities (Prevention) Act.The appeals have been filed under Section 21 of the National Investigation Agency Act against the trial court’s July 4 order refusing bail to Khalid and Imam.The trial court had cited the fact that it had no option but to follow the Supreme Court’s judgment denying bail to both of them.The Supreme Court had denied bail to them in January this year. Their co-accused facing the same FIR were released. In May, a separate bench appeared to doubt the judgment in the controversial order.
