New Delhi: The Nagaland assembly has unanimously adopted a resolution against a Uniform Civil Code (UCC), seeking an exemption for the state if such a Code is brought in. The Bharatiya Janata Party is a partner in the Nationalist Democratic Progressive Party-led government in the state.The resolution stated that the apparent objective of a UCC “is to have a single law on personal matters such as marriage and divorce, custody and guardianship, adoption and maintenance, succession and inheritance”. This would pose a threat to Naga customary laws and social and religious practices “that will be in danger of encroachment in the event of imposition of UCC”, The Indian Express reported.Chief minister Neiphiu Rio had moved the resolution.The resolution also talked about how the state government had earlier expressed its opinions to the 22nd Law Commission which had invited suggestions regarding the UCC in June this year.The resolution emphasised on Article 371(A) of the Constitution that states, “No act of Parliament in respect of religious or social practices of the Nagas; Naga customary law and procedure; administration of civil and criminal justice involving decisions according to Naga customary law; ownership and transfer of land and its resources, shall apply to the State of Nagaland unless the Legislative Assembly of Nagaland by a resolution so decides.”Mizoram and Kerala too have earlier adopted resolutions against the UCC.
