New Delhi: After Justice Biren Vaishnav of the Gujarat high court apologised during court proceedings on Wednesday (October 25) for rebuking his colleague, the court has asked YouTube to take down videos featuring his apology, the Indian Express reported.Its report added that several websites had removed the video citing a “copyright claim by the Gujarat high court”.Justice Vaishnav rebuked his junior colleague Justice Mauna Bhatt in court on Monday (October 23).“You differ yaar … then you differ. You have differed in one, differ in the other,” Justice Vaishnav is heard angrily saying in a video of the incident.When Justice Bhatt replied that “it is not a question of differing,” he shot back saying “then don’t murmur”.He continued to ask Justice Bhatt to pass a separate order before walking away from his chair.A video of the incident does not seem to be available on the high court’s YouTube channel.In a live stream of court proceedings from Wednesday, Justice Vaishnav is seen apologising for his conduct on Monday.“Before we begin the session, what happened on Monday shouldn’t have happened, I was wrong. I’m sorry for that and we begin a new session,” he said.“It shouldn’t have happened, it just, I don’t know… I was wrong,” he continued.Livestreams posted by the channel contain a “copyright warning”.This says that according to the Gujarat High Court (Live Streaming of Court Proceedings) Rules, 2021, the high court holds copyright over the streamed feeds.“Unauthorised use/re-use, capture, editing/re-editing, distribution/redistribution, or creating derivative works or compiling the live streamed feed/videos or using the same for any commercial purpose, in any form, will not be permitted,” the rules say.However, the rules clarify that links to the “entire videos as live streamed/uploaded by the high court may be used/embedded for any informational, educational and/or academic purposes.”
