Notwithstanding the provisions of the 2008 bilateral treaty, considering the gravity of the charges Pakistan was levelling against Shri Kulbhushan Jadhav, consular access ought to have been provided. Further, whatever may be the normal procedure followed in its military courts for its own citizens, for an Indian national, whom the Lahore Bar Association refuses to represent, the Indian High Commission should have been permitted to arrange for his legal defence.
